Introduction

This website, www.merairterre.com, is operated by SARL MATWATCHES, registered at the Paris Companies and Commercial Registry, registration number 501 236 004, with its registered office located at 18 Rue Vignon, 75009 PARIS. These General Terms and Conditions set out the terms of sale between MER-AIR-TERRE and the User, from placing the order through to after sales service, including payment and delivery.

1. Accepting the terms and conditions

The customer acknowledges having been made aware, at the time of placing the order, of the specific terms and conditions of sale shown on the screen, and the customer expressly and unreservedly accepts them. These general terms and conditions of sale govern the contractual dealings between the Website and its customers, and both parties accept them unreservedly. These general terms and conditions of sale prevail over any other terms and conditions appearing in any other document, unless expressly agreed otherwise in writing beforehand.

2. The products

The products governed by these General Terms and Conditions of Sale are those that appear on the website. They are offered for sale within the limits of stock available.

3. Prices

Product prices are stated in euros inclusive of all taxes. They include VAT and any reductions applicable on the day of the order. Product prices are stated exclusive of delivery expenses (carriage, packaging and parcelling, which are charged at the applicable rate). The total for delivery expenses will be shown on the purchase order before the order is confirmed. If one or more taxes or levies, particularly environmental taxes or levies, should be created or amended, either upward or downward, such changes may be passed on into the selling prices of the Products shown on the website and in the various sales material. However, prices cannot be changed once the User’s order has been confirmed.

4. The order

To place orders, Users must identify themselves with their email address or customer number and password. For the very first order, Users must follow the procedure shown on the Website for creating an account. Once the basket has been confirmed, Users must accept the General Terms and Conditions, choose the delivery address and method, and finally confirm the method of payment. All orders entail acceptance of the prices and descriptions of the products offered for sale. MER-AIR-TERRE will send an email acknowledging receipt of the order when it is confirmed. In some cases, particularly payment failures, incorrect addresses or other user account problems, MER-AIR-TERRE reserves the right to suspend the User’s order until the problem is solved. If any Product ordered is not available, the User will be notified by email. For any questions on the progress of an order, Users should look at their customer account on the MER-AIR-TERRE website.

5. Methods of payment

Users can choose to pay for their purchases:

– by bank card: Carte Bleu Credit Card, e-Carte Bleu Credit Card, Visa, Mastercard, or American Express. User accounts will not be debited until the available Products are dispatched. Where Products are out of stock or no longer available, Users will be debited only with the value of the items actually despatched.

– by bank transfer: If you are transferring money, remember that it may be several days – even a week in the case of international transfers – before the money is credited to our account. As soon as we have received the amount due, we will process your order and you will receive an email telling you that payment has been made for your order. Note that public holidays may cause delays with your transfer.

6. Delivery

IMPORTANT: All our parcels are insured throughout the dispatch process, and the carriage risks are borne by the seller, provided the buyer has checked the goods (inside and outside) on receipt in the presence of the carrier and has noted any reservations on the delivery note in writing, even for freight-paid shipments. If packages are too badly damaged, buyers should refuse them. That is the only way you can obtain a refund for breakages from MERAIRTERRE. If a package is lost in transit, investigation times may vary. If reservations were recorded at the time the package was delivered, these must also be notified to the carrier by registered letter with acknowledgement of receipt within 48 hours, sending us a copy of the letter, together with a copy of the invoice and the original packet. Delivery times are given on an indicative basis only, and failure to meet these time limits cannot give entitlement to any retention, allowance, damages and interest or compensation. To enable delivery times to be met, customers must ensure that they have given full and accurate delivery address information (in particular: road number, building number, stair, entry codes, names and/or intercom numbers, etc.). The company cannot be held liable for any consequences of late delivery that are not attributable to it.

6.1. Deliveries in France Deliveries will be made within 14 working days, provided the delivery information given is correct.

Preparation, quality control and dispatch are free of charge in Metropolitan France. The standard dispatch method is tracked delivery handed over against signature. The carrier is selected by us, depending on the destination. In the case of obvious faults, buyers are entitled to return the goods on the terms set out in this document.

6.2. Deliveries in Europe excluding France and Monaco Deliveries will be made within 14 working days, provided the delivery information given is correct).

Preparation, packaging, quality control and delivery are charged at a flat rate of €80, regardless of destination.

For deliveries outside metropolitan France, the customer undertakes to pay all taxes due on importation of the products, all customs duties, value-added tax and all other taxes due under the laws of the country in which the order is received. MERAIRTERRE declines any legal liability if the customer has not paid the taxes. The following are to be considered as cases of force majeure, releasing the seller from its obligation to deliver: war, riot, fire, strikes, accidents and inability to obtain supplies.

7. Right to cancel or exchange

7.1. Right to cancel (for deliveries in Europe only).

You have 14 days from the date of receiving the items to decide whether you want to keep them. For exchange or refund, please contact us and then send back the new item/items in their original packaging, intact, together with the purchase invoice, to the following address: MERAIRTERRE – MATWATCHES SAV 18 rue Vignon 75009 PARIS, France. If you exercise the right to cancel, MERAIRTERRE is required to refund the amounts the customer has paid, without charge, except for return carriage costs. Initial carriage expenses will be refunded only for deliveries in Metropolitan France. MERAIRTERRE undertakes to refund Users exercising their cancellation rights as soon as possible, and at the latest within thirty (30) days following exercise of their cancellation rights. MERAIRTERRE will refund Users for Products returned, provided the above terms have been observed, together with the basic “outward” order delivery charges if the User is returning the whole order. If the user does not return the whole order and retains one or more of the Products ordered, all the “outward” delivery charges will be kept to by MERAIRTERRE.

7.2. Exchange

Users also have a time limit of fifteen (15) days to request an exchange. Users will then not have to pay delivery costs on the new exchange order. Users can return their Product to MERAIRTERRE – MATWATCHES by the La Poste public postage service at their own expense.

8. Guarantee

All Products sold on MERAIRTERRE come with a two-year guarantee, except for the straps, which are not guaranteed. Customers receive the peaceful possession andlatent faults guarantees provided for in law (Art.1625 et seq of the Civil Code). Provided the buyer produces evidence of the latent fault, by law the seller is obliged to make good all the consequences of that fault (art.1641 et seq of the Civil Code); if the buyer applies to the court, application must be made within a maximum of two years from discovering the latent fault (art.1648 of the Civil Code). You can contact customer service: 5 days out of 7 (Mondays to Fridays inclusive) by emailing contact@merairterre.com. MERAIRTERRE has set up a procedure for returns covered by the guarantee:

1) If you find a problem, please contact the MERAIRTERRE after sales department by emailing contact@merairterre.com. Never send back your watch without first obtaining prior authorisation from MERAIRTERRE.

2) If you are sending back goods, you must send your watch back in its original packaging.

9. Disputes

This contract is subject to the laws of France

MERAIRTERRE – MATWATCHES cannot be held liable for loss of any kind, physical, consequential or bodily, that may arise from the faulty working or improper use of the products marketed. The responsibility of MERAIRTERRE – MATWATCHES will in all cases be restricted to the total of the order, and cannot be invoked for simple errors or omissions that may remain in spite of all the precautions taken in product presentation. In the event of problems in applying this contract, the buyer can, before applying to the courts, seek an amicable settlement, in particular with the help of an appropriate industry association, consumer association, or any other adviser of their choice.

Buyers are reminded that seeking an amicable settlement does not suspend the time limit for either the statutory or the contractual guarantee. Buyers are reminded that as a general rule, and subject to the opinion of the courts, adhering to the terms of this contract relating to the contractual guarantee presupposes that the buyers honour their financial commitments to the seller. Complaints and claims are always handled in a helpful and positive spirit, and it is always assumed that a buyer who is taking the trouble to explain the situation is acting in good faith. In the event of disputes, customers should give preference to approaching the company to reach an amicable settlement.

10. Personally identifiable information

Data gathered on this site will be used to process your order. Items marked with an asterisk are compulsory. If you choose not to provide them, we will not be able to process your order. This information is for the exclusive use of MERAIRTERRE and will under no circumstances be passed on to anyone else without your agreement. Under the law of 6 January 1978, you have the right to access, amend, correct or delete the data held on you. Please apply to the MERAIRTERRE registered office to exercise this right.

11. Applicable law and competent courts

These General Terms and Conditions are subject to the laws of France. In the event of a dispute, the competent court will be that of the area of the defendant’s place of residence or, at the plaintiff’s option, the place of actual delivery of the Product. The Website complies with French legislation, but in no case does MERAIRTERRE guarantee that it complies with local legislation applicable to you, if you are accessing the Website from other countries.
